About These Terms

These Terms of Service govern your use of the Montgomery Wealth digital investment platform (the "Platform") operated by Keith Montgomery Associates Limited, trading as Montgomery Wealth("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms.

Eligibility

To use our Platform, you must:

• Be at least 18 years old
• Be a British citizen or UK resident for tax purposes for the last three or more years
• Have a valid UK bank account in your own name
• Provide accurate and complete information during registration
• Not be a US Person or Green Card holder for tax purposes
• Meet suitability criteria

Our Services

The Platform provides access to our portfolio service (MPS), a discretionary investment management service on a non-advised basis. This means that you are responsible for choosing from a selection of ready-made model portfolios without a recommendation or financial advice, and we make investment decisions on your behalf based on your selected portfolio and risk profile.

What We Provide

• Access to three managed portfolios: Cautious MPS, Moderate MPS, and Growth MPS
• Investment accounts including ISAs, Junior ISAs and General Investment Accounts (GIA)
• Educational content and resources
• Online portfolio monitoring and reporting

What We Do Not Provide

• Personal financial advice tailored to your individual circumstances (available for an additional charge)
• Tax advice (please consult a qualified tax adviser)
• Guaranteed returns on investments

Investment Risks

Before investing, you must ensure you understand the risks involved and that the investment is suitable for your circumstances. Our educational resources can help you understand these risks, but they do not constitute personal advice. You may request financial advice from us for an additional charge if required.

Your Account

Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access
• Ensuring your contact information remains up to date

Account Restrictions

You must not:

• Share your account with others
• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Interfere with the proper operation of the Platform

Fees and Charges

Our fee structure includes:

• Platform Fee: 0.30% per annum
• Management Fee: 0.50% per annum
• Underlying Fund Charges: Ongoing Charges Figure (OCF) varies by portfolio

Full details of all charges are provided in the MPS Factsheet, which you will receive on opening your account. VAT does not currently apply.

Cooling-Off Period

For ISA and Junior ISA accounts, you have a 30-day cooling-off period from account opening. During this period, you can cancel without penalty. However, if your investments have decreased in value, you may receive less than you invested.

Intellectual Property

All content on the Platform, including text, graphics, logos, software, portfolio construction and asset allocation, is owned by Montgomery Associates or our licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

Limitation of Liability

While we take reasonable care in providing our services, we do not accept liability for:

• Investment losses arising from market movements
• Losses caused by circumstances beyond our reasonable control
• Indirect or consequential losses
• Technical failures or interruptions to service

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts. However, you may also be able to use the Financial Ombudsman Service for eligible complaints.
